Your Product Was Recalled. You Deserve a Refund. Here’s How to Get It.
Federal law requires manufacturers to provide a free remedy for recalled products — whether that’s a full refund, a free replacement, or a repair. But companies routinely stall, offer partial credit, or simply ignore consumers. If you’re stuck in refund limbo, this guide gives you the exact words to say and write to get your money back.
📋 The Escalation Ladder
Step 1: Contact the Manufacturer (Day 1)
Use the contact information in the official recall notice — not the general customer service line. The recall notice specifies a dedicated recall team with the authority to process refunds. Reference the specific recall number (e.g., “CPSC Recall #26-XXX”) in your first sentence.
Step 2: File a CPSC Complaint (Day 7)
If the manufacturer hasn’t responded within 7 business days, file a formal complaint at SaferProducts.gov. This creates an official government record and triggers a follow-up from the CPSC to the manufacturer. Companies take CPSC complaints seriously because they can lead to enforcement actions.
Step 3: Contact Your State Attorney General (Day 14)
Every state has a consumer protection division within the Attorney General’s office. File a complaint citing the manufacturer’s failure to honor a federally mandated recall. Most states allow online filing. This adds regulatory pressure from a second direction.
Step 4: Credit Card Chargeback (Day 21)
If you purchased the product with a credit card within the last 120 days, you may be able to file a chargeback. Cite “product not as described — subject to federal safety recall” as the reason. Include the CPSC recall notice as documentation.
Step 5: Legal Action (Day 30+)
If you suffered injuries or property damage from a recalled product, you may be entitled to compensation beyond the refund. Consumer protection attorneys typically work on contingency (no upfront cost). Document everything — photos, medical records, repair bills, and all communications with the manufacturer.
Common Refund Roadblocks
“We can only offer store credit.” — Federal recall remedies are not limited to store credit. If the recall notice specifies a “refund,” you are entitled to your money back. Cite the specific recall notice language.
“You need the original receipt.” — Most recalls do NOT require the original receipt. A credit card statement, email confirmation, or even a photo of the product with the serial number is typically sufficient. The recall notice will specify what documentation is actually required.
“That product is too old for a refund.” — There is no expiration date on a safety recall. If a product was recalled, the manufacturer is obligated to provide the specified remedy regardless of when you purchased it.
“We already threw it away.” — Many recalls require you to destroy the product and send photos as proof. If you already disposed of the product, explain this to the manufacturer. Some will still honor the refund with alternative proof of purchase.
